Terms of Use for Automotive Dealership Report Generation Tool
Welcome to the Automotive Dealership Report Generation Tool ("the tool"). These Terms of Use ("Terms") govern your access to and use of the tool. By accessing or using the tool, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the tool. Please read them carefully before proceeding.
1. Disclaimer
This tool is provided "as-is," without any warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. The provider does not guarantee uninterrupted availability of the tool or error-free results or reports.
2. User Data
Users may only input information related to their own dealership. By using this tool, users warrant they have all necessary rights and permissions to input such data and to use the tool in compliance with applicable laws and regulations.
3. Usage Restrictions
Generated reports are for the user’s internal purposes only. Users are prohibited from distributing, sharing, or otherwise making the reports available to any third party.
4. Indemnity
Users agree to indemnify and hold the provider harmless from any claims, liabilities, or damages arising from or related to the use of the tool or any reports generated therefrom.
5. Limitation of Liability
The provider shall not be liable for any indirect, incidental, consequential, or punitive damages relating to or arising from the use of the tool, even if advised of such potential damages. The provider's total liability shall not exceed the fees paid by the user (if any) for access to the tool.
6. Termination of Access
The provider reserves the right to terminate or suspend user access to the tool at any time, for any reason, including but not limited to violation of these terms.
7. Ownership of Tool and Reports
The tool, its design, and proprietary algorithms remain the exclusive property of the provider. Users are granted a non-exclusive, revocable license to use the tool and the reports generated therefrom solely as permitted herein.
8. Prohibited Activities
Users are prohibited from:
- Reverse-engineering or attempting to extract the tool’s source code.
- Using the tool to process data for third parties.
- Engaging in activities that violate applicable laws or regulations.
9. Use of User Data
The provider may use data input by users to improve the tool, including for training and refining machine learning algorithms. Such use will comply with applicable data protection laws.
10. Feedback
Users agree that any feedback, suggestions, or ideas provided to the provider regarding the tool may be used by the provider for any purpose without any obligation to compensate the user.
11. Modification of Terms
The provider reserves the right to modify these terms at any time, with or without notice. Continued use of the tool constitutes acceptance of the modified terms.
12. Jurisdiction and Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of California. Any disputes shall be resolved exclusively in the courts located in Contra Costa, California.
13. No Unauthorized Access
Users are prohibited from accessing or attempting to access the tool or related systems in an unauthorized manner.
14. Agreement to Terms
By using this tool, users agree to these terms. If you do not agree, you must not use the tool.
